A Commercial General Liability (CGL) policy is every company’s first line of defence against the risk of liability arising from its operations. Such a policy provides seamless protection to the Insured, and covers Third Party Liabilities arising from various business exposures. Put simply, a CGL policy protects your business from financial loss should you be liable for property damage or personal and advertising injury caused by your services, business operations or your employees. It also covers non-professional negligent acts.

So whether it is an employee that causes unintentional damages during the course of his/her work, or lawsuit is filed against your business, alleging advertisements constituted misleading information; a CGL policy ensures your company’s reputation and finances are secure.

HOW DOES IT WORK?

Our Commercial General Liability Policy includes three standard types of coverage:

Coverage A

Bodily Injury & Property Damage Liability

Bodily injury and property damage coverage provides protection against losses caused by your company having to pay damages due to bodily injury or property damage of a third party. Such a case may arise out of non-professional negligent acts or for liability arising out of your premises or business operations. The coverage can also extends to mental injuries and emotional distress, even in the absence of physical bodily harm.

In legal terms, under this section your insurance company will indemnify the insured against those sums that you company becomes legally liable to pay as damages because of bodily injury or property damage to a third party. This amount will however be limited to the amount described as the Limits of Insurance in the Policy Schedule.

Additionally your insurance company will have the right and the duty to defend the insured against any suit seeking those damages. The insurance will apply to bodily injury or property damage only in the case when the bodily injury or property damage is caused by an occurrence that takes place in the coverage territory within the policy period.

In countries where the law of the laws of the territory don’t permit the insurance company to defend, the insurance co. will also reimburse your business for the defence costs, subject to insurance company’s prior authorization in writing.

Coverage B

Personal & Advertising Injury

Personal and Advertising Injury coverage is designed to protect your business against liabilities arising from specific offenses, such as libel, slander, malicious prosecution as well as charges brought against the business such as misleading advertising and the like.

Under this section the insurance company will indemnify your business against those sums that it becomes legally liable to pay as damages because of Personal & Advertising Injury to which the insurance applies. This amount will however be limited to the amount described as the Limits of Insurance in the Policy Schedule.

Here also, the insurance company will have the right and the duty to defend your business against any suit seeking those damages. The insurance coverage in this section applies to personal and advertising injury caused by an offense arising out of your business, but only if the offense was committed within the coverage territory within the policy period.

Caused by or at the direction of the insured | Arising out of oral or written publication of material if done at the direction of the insured with the knowledge of its falsity | Arising out of oral or written publication of material whose first publication took place before the policy inception | Arising out of criminal act committed by or at the direction of the insured | For which the insured has assumed liability under a contract or agreement | Arising out of breach of contract | Arising out of failure of goods, products or service to conform with any statement of quality or performance made in the insured’s advertisement | Arising out of wrong description of the price of goods, products or service stated in the insured’s advertisement | Arising due to pollutants | Arising due to war or related activities

Coverage C

Medical Expenses

This section allows for a limited coverage towards medical payments and can be triggerd without legal action. The aim of this coverage is to enable prompt medical attention as well as quick settlement of minor medical claims without the need of litigation. Under this, the insurance company will pay for the medical expenses as described below for bodily injury caused by an accident:

  • At the insured’s premises.
  • On ways next to the premises owned by the insured.
  • Because of insured’s operations.

This coverage is only provided if the accident takes place within the coverage territory within the policy period, and the accident is reported to the insurance company within 30 days of the date of accident. Such payments will be made regardless of fault, thought the payments will not exceed the applicable limit of insurance. Under this, reasonable expenses will be paid for:

  • First aid administered at the time of an accident.
  • Necessary medical, surgery, X-Ray, and dental services including prosthetic devices.
  • Necessary ambulance, hospital, professional nursing and funeral expenses.

The Insurance company will not pay for bodily injury:

To the Insured | To Any person hired or employed by the insured or a tenant of the insured | To a person injured on that part of the premises that the insured owns or rents that the person normally occupies | To a person whether or not employed by the insured, if the benefits for the bodily injury are payable under WC Policy or disability benefits law or a similar law | To a person injured while taking part in athletics | Included within the Products-completed operations hazard | Excluded under Coverage A | Due to war or condition incident to war.
